Within the scope of KKDIK legislation; chemical substance registration applications made in Turkey can be made by companies located within the borders of Turkey. Due to the Only Representative provision of the relevant Regulation, foreign companies can perform the necessary actions through the Only Representative. In short, companies that are not resident in Turkey but offer their products to the Turkish market may appoint a resident Only Representative within the borders of Turkey to fulfill the provisions of the relevant Regulation.

Follow-up of the updates of the article information and notification to the Ministry
KKDIK (Turkey REACH) Only Representative: KKDIK Regulation No. 30105 imposes responsibilities on parties dealing with chemicals, especially manufacturers and importers. Pursuant to ARTICLE 9 of the KKDIK Regulation, manufacturers who are not resident in Turkey may appoint an Only Representative residing in Turkey for the transactions that must be carried out within the scope of KKDIK, in order to fulfill their responsibilities. The Only Representative must have sufficient knowledge of the substance and its use. If the foreign manufacturer companies that import the substance in its own form, in a mixture or in an article, appoint an Only Representative for the relevant substance, the responsibilities of the importer company residing in Turkey are carried out through the Only Representative. The Only Representative is responsible for ensuring that the relevant articles are available in Turkey in accordance with the relevant provisions. In this case, within the scope of KKDIK, the importer company is considered as a "Downstream User" for the relevant article. A foreign company may appoint only one Only Representative for an item. However, it may appoint different Only Representatives for its different agents.
SEA Regulation Only Representative: According to SEA Regulation No. 28848, substances with hazard classification must be notified to the Ministry of Environment and Urbanization. At the same time, if the classification and labeling information of the substance is updated, these updates must be notified to the Ministry. In accordance with Article 41(1) of the SEA Regulation, SEA notifications can only be made by companies established in Turkey. In accordance with ARTICLE 41 (4) of the SEA Regulation, the foreign company may appoint an Only Representative for the substances imported on their own or in a mixture, by reaching an agreement between the Turkish company and itself. In this case, the SEA notification is made by the Only Representative.
